1. About these Terms

These Terms and Conditions ("Terms") govern your use of the website published at web-gate.org ("the Site"). The Site is operated by Web-Gate Studio / Студия Web-Gate (an individual private person, Ukraine). By visiting the Site you accept these Terms. If you do not accept them, please do not use the Site.

2. What this Site is

The Site is the public showcase of an independent web studio. It includes a portfolio of completed projects, descriptions of services, articles on web design and development, and a contact form for enquiries. The Site is provided free of charge for general informational purposes.

3. The portfolio and service descriptions are not a binding offer

Pages that describe services we have provided to past clients, and pages that describe what we generally do (e.g. site creation, SEO, copywriting), are illustrative. They are not a public offer in the sense of Article 633 of the Civil Code of Ukraine. Any actual engagement — scope, price, deliverables, timeline, intellectual-property arrangements — is agreed in a separate written contract between the parties. Until such a contract is signed, no obligation arises on either side.

4. The contact form

The contact form on the Site lets you start a conversation with us. By submitting it, you confirm that:

  • the name and email address you provide are your own, or you have authority to use them;
  • the information you put in the message is accurate to your knowledge and is shared by you voluntarily;
  • you are not using the form to send unsolicited commercial content, automated messages, illegal content, or anything that would be unlawful under Ukrainian law.

We will use what you send us solely to read your message and reply (see our Privacy Policy for the data-protection side of this). We may decline to reply, and we may stop a correspondence at any time, without giving a reason. If we do reply, our reply is not by itself a binding offer of services — it is part of the pre-contract discussion described in section 3.

5. Intellectual property

Unless explicitly attributed to a client or third party, all text, illustrations, screenshots, code samples, video and other content on the Site is the property of Web-Gate Studio and is protected by the copyright laws of Ukraine and international treaties.

Portfolio pages include screenshots and descriptions of work delivered to past clients. The underlying website, brand, logo and content on each client site belong to the respective client; the screenshot is shown here with their permission, or under the implied right of a portfolio author to refer to their work after delivery, as is customary in the industry.

You are welcome to read and link to our pages. You may quote short excerpts for non-commercial personal use, provided you clearly credit Web-Gate Studio and link to the original page. Any other use — including republishing whole articles, mirroring, training a model on our content, or commercial reproduction — requires our prior written permission.

6. Acceptable use

You agree not to:

  • circumvent or attempt to circumvent the Site's security measures, access controls, or rate limits;
  • scrape, crawl or otherwise extract content from the Site in a way that exceeds reasonable, polite, well-behaved use (i.e. respect robots.txt, identify yourself in the User-Agent, do not hammer the server);
  • attempt to gain unauthorised access to any part of the Site, the underlying server, the contact-form backend, or related infrastructure;
  • use the contact form to send unsolicited commercial content, automated messages, or anything that would be unlawful under Ukrainian law;
  • impersonate any person in the name, email or message fields of the contact form.

The Site maintains a discreet honeypot link — invisible to humans and disallowed in robots.txt — that automatically flags badly-behaved bots and adds the offending IP to a temporary block list. This is described in our Privacy Policy.

7. External links

Some pages link to third-party websites (for example, the live sites of past clients). We provide these links for your convenience and information only. We do not endorse the linked content and we are not responsible for its availability, accuracy or any consequences of using it. When you follow such a link, the privacy policy and terms of that third-party site apply.

8. Availability

We try to keep the Site available at all times, but we cannot and do not guarantee that it will be available without interruption, error-free, or free from harmful components. We may suspend or withdraw access (in whole or in part) without notice — for example, for maintenance — and we will not be liable to you if the Site is unavailable for any reason and for any period.

9. Disclaimer of warranties

The Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied — including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the information on the Site is accurate, complete, current, or free from errors. Any reliance you place on portfolio descriptions, service summaries or article content is at your own risk.

10. Limitation of liability

To the maximum extent permitted by Ukrainian law, in no event will Web-Gate Studio, its operator, or its contributors be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Site or any content on it. Nothing in these Terms excludes or limits our liability for fraud or for any other liability that cannot lawfully be excluded under Ukrainian law.

11. Changes to these Terms

We may update these Terms from time to time. The current version is always available on this page, and the "Last updated" date at the top reflects the date of the most recent change. By continuing to use the Site after a change you accept the updated Terms.

12. Governing law and jurisdiction

These Terms are governed by the laws of Ukraine. Any dispute arising out of or in connection with the Site or these Terms shall be subject to the exclusive jurisdiction of the courts of Ukraine.
